Luxury Kulture: Terms & Conditions

Welcome to Luxury Kulture. By accessing or using our website (the "Site") and services (the "Services"), you agree to comply with and be bound by these Terms and Conditions (the "Agreement"). Please read them carefully.
If you do not agree to these Terms, you must not access or use the Site. This Agreement governs your access to and use of the Site, including any content, functionality, and services offered through the Site.
1. Overview of Services
Luxury Kulture is an online marketplace for buying, selling, and consigning luxury items, including apparel, accessories, watches, jewellery, furniture, art, and collectibles (the "Items").
We provide a curated platform for individuals (the "Consignors") to consign and sell their pre-owned luxury goods, and for buyers (the "Buyers") to purchase these Items.
Luxury Kulture operates as a professional reseller and may sell Items directly through our website or via approved third-party marketplaces.
2. Consignment Agreement
2.1 Consignor Account
To consign items with Luxury Kulture, you must create a consignor account and provide accurate contact and payment information.
2.2 Consignment Process
By submitting items for consignment, you agree to the consignment terms outlined in the Consignment Agreement (Appendix C), including pricing, commission rates, markdown policies, and return terms.
2.3 Ownership & Risk
You retain ownership of your items until they are sold. Luxury Kulture assumes risk of loss or damage only after items are in our physical possession or shipped using our approved shipping method.
3. Multi-Platform Selling & Professional Marketplace Presence
3.1 Cross-Listing of Items
To maximise exposure and achieve optimal sale outcomes, Luxury Kulture may list and sell Items on third-party platforms in addition to our website. These may include established luxury resale marketplaces where we are registered as professional sellers (for example, Vestiaire Collective and other similar platforms).
3.2 Platform Policies
Sales completed through third-party platforms are subject to the policies, buyer protections, and dispute procedures of that platform. Where required, Luxury Kulture will comply with the terms of those marketplaces.
3.3 Availability & Delisting
Items may be listed across multiple channels simultaneously. Once sold on any platform, the item will be removed from all other listings. Luxury Kulture is not liable for any delay in removal caused by technical or platform-related issues.
3.4 Pricing Variations
Pricing may vary slightly across platforms due to platform fees, commission structures, or promotional campaigns.
4. Buyer Terms
4.1 Purchasing Items
Buyers may purchase items through Luxury Kulture’s website or approved third-party marketplaces. All sales are final unless otherwise required under Australian Consumer Law or as outlined in Section 8.
4.2 Payment Processing
Payments are processed through secure payment gateways (e.g., Stripe, PayPal). By making a purchase, you authorise Luxury Kulture to charge the agreed purchase amount.
4.3 Shipping
Luxury Kulture manages shipping and fulfilment. Shipping fees are calculated at checkout and are the responsibility of the Buyer unless otherwise stated.
5. Account Responsibilities
5.1 You must provide accurate and up-to-date information.
5.2 You are responsible for maintaining account confidentiality.
5.3 Prohibited activities include:

Submitting counterfeit or misrepresented goods

Using the Site for fraudulent purposes

Interfering with platform functionality

Attempting unauthorised access
6. Item Condition & Acceptance
6.1 Seller Obligations
Consignors must provide accurate and complete information regarding condition, provenance, and authenticity.
6.2 Luxury Kulture’s Role
We review all submissions and may authenticate, reject, or remove items at our discretion.
6.3 Responsibility
While Luxury Kulture curates and lists items, ultimate responsibility for authenticity and ownership rests with the consignor.
7. Fees & Commission
7.1 Commission Structure
Commission rates are outlined in Appendix C and vary depending on category and sale value.
7.2 Payments to Consignors
Payments are issued within 5 business days after a confirmed sale, provided:

Buyer payment has cleared

Any applicable dispute or platform review period has passed
If sold via a third-party platform, payout timing may be subject to that platform’s payment release schedule.
Payments are made via bank transfer, PayPal, or store credit as nominated by the consignor.
7.3 Returns & Refunds
Items are final sale unless damaged in transit or materially misrepresented.
8. Shipping & Handling
8.1 Shipping Costs
Shipping fees are calculated at checkout and payable by the Buyer unless stated otherwise.
8.2 Oversized Items
For oversized items (e.g., furniture or art), consignors retain possession until sold. Luxury Kulture coordinates delivery, and shipping costs are payable by the customer.
8.3 Risk of Loss
Luxury Kulture assumes responsibility once items are in our possession. Transit issues are handled under our Shipping Insurance Policy.
9. Returns & Refunds
9.1 All items are sold as-is as a second-hand marketplace.
9.2 Buyers must notify Luxury Kulture within 48 hours of delivery for transit damage claims.
9.3 Returns will not be accepted for size, fit, style, or disclosed condition issues.
Nothing in these Terms excludes rights under Australian Consumer Law.
10. Intellectual Property
All content on the Site is owned by or licensed to Luxury Kulture and protected under copyright law.
11. Privacy & Data Protection
We collect and use personal information in accordance with our Privacy Policy.
12. Limitation of Liability
The Site and Services are provided “as is.”
To the fullest extent permitted by law, Luxury Kulture shall not be liable for indirect or consequential damages. Liability for any claim related to a purchase is limited to the amount paid for the item.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Australia and the State of NSW.
Disputes will first be referred to mediation in NSW before further legal action.
14. Amendments
Luxury Kulture may update these Terms at any time. Continued use of the Site constitutes acceptance of the updated Terms.
